This is a paper which I wrote primarily for laypeople although it is also intended for lawyers who do not primarily practice in the habeas area. It is, simply, an introduction to the concepts involved in Texas post-conviction habeas corpus. It is not meant to be a legal document, it has no citations and does not discuss individual cases. What it does try to do is to set up the framework of the post-conviction system so that additional research can be properly placed and understood. It could be used, for example, by an attorney wishing to introduce a client, or a parent of a client, to the habeas area. How it is ultimately used is up to you. The only thing I ask is that you seek permission before you use the paper, or parts of it, as a publication or in a one.
Thanks for your interest. If there are any suggestions or questions please address them to me through the good offices of the Texas Independent Bar Association. And, most of all, Good Luck!
